However, if she has stayed there for over two months, she legally has ninety days to leave as per tenant law.

If she's living at your place... there's your first mistake. Second mistake, you leaving her alone in your place to make distance. Make her (or him) leave and make sure they take all their stuff with them. Don't let them leave anything behind to come back for. Just say you need a lot of time to "process" what happened and tell them to not contact you. If they email, call or text just keep ignoring them. Don't read or listen to their communications until you think you can handle it. And DO NOT ERASE their voice mails, emails or text messages. You never know if you'll need them for court.
