does not need a law, the constitution states that you cannot just take private property and if the land is sold to the state/federal-gov. must pay a proper price for the private property that is property SOLD with a proper bill of sale and proper compensation...
you can file a lawsuit they fifth circuit is full of shit, they cannot stop anyone from filing a lawsuit PERIOD!!!
proper compensation for damaged property is to be paid, in this case it would be ANNUALLY recompense for damages...
the fed/state cannot take away your rights or they are GOD GIVEN RIGHTS not gov. given rights...
